To be an authorised affiliate of Oddsmart from MatchedMedia, you agree to abide by the terms and conditions contained in this agreement.
Please read this agreement carefully before registering and using the Oddsmart.co service as an affiliate.
By signing up for the Oddsmart affiliate program, you indicate your acceptance of this agreement and its terms and conditions.
Oddsmart Affiliate Programme
Terms & Conditions
Effective Date: [18th June 2025]
These Terms & Conditions (“Agreement”) govern your participation in the Oddsmart Affiliate Programme (the “Programme”).
By enrolling as an affiliate (“you” or “Affiliate”), you agree to be bound by this Agreement.
If you do not agree to these terms, you must not participate in the Programme.
1. Definitions
Oddsmart from MatchedMedia Ltd, a company registered in England and Wales (Company No. 16278368), whose registered office is at 7 Oak Road, Cobham, United Kingdom, KT11 3AZ.
Affiliate: Any individual or legal entity accepted into the Programme to promote Oddsmart products and services.
Affiliate Link: A unique tracking URL provided by Oddsmart that records referrals from the Affiliate to Oddsmart’s website.
Qualified Referral: A sale of a paid subscription (Basic, Pro or Elite) to Oddsmart made by a new customer who clicks the Affiliate Link and completes payment.
Commission: The fee payable by Oddsmart to the Affiliate for each Qualified Referral, calculated as set out in Schedule A.
Term: The period during which this Agreement is in effect, as set out in Section 8.
2. Enrollment & Approval
Application. To participate, you must submit a Programme application via our website.
Eligibility. Affiliates must be aged 18 or over and comply with all applicable laws and regulations.
Approval. Oddsmart reserves the right to accept or reject any application at our sole discretion. Approval is confirmed by email.
3. Affiliate Obligations
Use of Links. You will promote Oddsmart solely via the Affiliate Links and approved marketing materials provided.
Compliance. You must comply with all applicable laws, industry standards and these T&Cs.
Brand Guidelines. All use of the “Oddsmart” name, logo and trademarks must follow our Brand Guidelines.
Fair Promotion. You shall not engage in misleading, deceptive, spamming or other unfair marketing practices.
Restrictions. You may not:
Bid on “Oddsmart” or related terms in paid search campaigns;
Post on coupon, voucher or incentive-only sites without prior written consent;
Send unsolicited commercial electronic messages (“spam”) promoting Oddsmart.
4. Commission & Payment
Calculation. Commissions accrue on the date the customer’s subscription payment is received and cleared.
Rates. Commissions are payable per Qualified Referral at the rates set out in Schedule A.
Payment Threshold. You must accrue at least £50 in commissions before a payment is issued.
Payment Schedule. Commissions are paid monthly, within 30 days after the end of the calendar month, via bank transfer or PayPal (as elected).
Chargebacks & Refunds. If a customer’s subscription is refunded or charge-backed within 60 days, Oddsmart reserves the right to deduct the corresponding Commission from your next payment.
5. Intellectual Property
License. Oddsmart grants you a non-exclusive, revocable, royalty-free licence to use permitted marketing materials strictly in accordance with this Agreement.
Ownership. All content, trademarks and design rights in the marketing materials remain the sole property of Oddsmart.
6. Confidentiality
Each party agrees to keep confidential all non-public information received from the other party in connection with this Programme and to use it only for performing under this Agreement.
7. Representations & Warranties
You represent and warrant that:
You will comply with all applicable laws and regulations;
You have the full power and authority to enter into and perform this Agreement;
Your promotional activities will not infringe any third-party rights.
8. Term & Termination
Term. This Agreement commences upon your acceptance and continues until terminated.
Termination by Either Party. Either party may terminate this Agreement at any time, with or without cause, by giving 14 days’ written notice.
Immediate Termination. Oddsmart may terminate immediately in the event of a material breach, illegal conduct, or fraudulent referrals.
Post-Termination. Upon termination, you must cease all use of Affiliate Links and marketing materials. Commissions for Qualified Referrals earned prior to termination remain payable in accordance with Section 4.
9. Liability & Disclaimer
No Warranty. Oddsmart provides the Programme and marketing materials “as is” and disclaims all warranties, whether express or implied.
Limitation of Liability. To the fullest extent permitted by law, Oddsmart’s aggregate liability under this Agreement shall not exceed the total Commissions paid to you in the 12 months preceding the event giving rise to the claim.
10. Modification
Oddsmart may modify this Agreement or the Programme terms at any time by posting the updated terms on our website. Continued participation after notice constitutes acceptance of the changes.
11. Governing Law & Dispute Resolution
This Agreement is governed by the laws of England and Wales. Any disputes arising shall be subject to the exclusive jurisdiction of the English courts.
12. Miscellaneous
Assignment. You may not assign or transfer your rights under this Agreement without Oddsmart’s prior written consent.
Entire Agreement. This Agreement constitutes the entire understanding between the parties regarding the Programme and supersedes all prior agreements.
Severability. If any provision is held invalid, the remainder shall continue in full force and effect.
Schedule A – Commission Structure
Commission Rate (35%)
Commission applies only to the customer’s initial paid subscription (monthly or annual).
We do pay recurring commissions on renewals.
